Welcome to the Hills of Inverrary Community News Blog!
The Hills of Inverrary News – Your “No Spin” source for real community updates. Independent, resident-led, and unaffiliated with the board, we serve up facts on governance, maintenance, and local happenings—with a twist of satire and a cartoon hat or two. No filters. No politics. Just transparency, education, and a little irreverent fun. Disclaimer: All posts use fictional satire for comedic commentary on board behavior.
1️⃣ Kaufman Language – Your Hidden Legal Shield
If your condo declaration includes “Kaufman language,” it automatically adopts current Florida statutes.
✅ This means the Board can’t make rules that conflict with state law.
⚠ Boards without Kaufman language sometimes exploit this to pass rules that ignore legislative intent—watch for that as a red flag. The Hills of Inverrary Condo Declaration were amended to include Kaufman language on June 5, 1998.
2️⃣ Selective Enforcement – The Law Must Apply to Everyone
Florida courts say if a rule is ignored for some owners, it can’t suddenly be enforced against just one person (White Egret Condominium v. Franklin).
✅ Uniform application = valid rule.
π« Picking and choosing who to enforce against = unenforceable rule.
3️⃣ Legislative Intent – The “Why” Behind the Law Matters
Even if a loophole exists, the purpose of the law matters.
Example: Recent state law changes protect personal-use pickup trucks. Rules banning them—especially if they’re well-maintained and free of commercial signage—violate that intent.
4️⃣ Fiduciary Duty – The Board Works for You
Under §718.111(1)(a), Fla. Stat., Board members must act in the best interest of all owners, respond to legitimate inquiries, and follow the governing documents.
π¨ Willful misconduct, retaliation, or bad-faith rulemaking can expose Board members to personal liability.
5️⃣ Your Tools to Push Back
Request records under §718.111(12).
Challenge unlawful rules via DBPR arbitration (§718.1255).
Seek injunctive relief in court for selective enforcement or breach of fiduciary duty.
Join with other owners to demand transparency and fair governance.
π¬ Tip: Today’s “small” overreach (like banning a ladder rack or sticker) can become tomorrow’s precedent for much bigger restrictions. Speaking up early protects everyone.
