Community Resource & Legal Notice

The Hills of Inverrary Audit Taskforce has been formed to investigate allegations of financial misconduct, misuse of association resources, and potential violations of Florida law. This page serves as both a community resource and a formal notice to current and former board members, employees, and contractors.

The Audit Taskforce Charter will include documented allegations and will be published publicly on this page. While individual names will not be disclosed at this stage, any substantiated evidence of impropriety will be referred to law enforcement, including:

  • Lauderhill Police Department
  • Federal Bureau of Investigation (FBI) if federal crimes are indicated

⚖️ Legal Framework

Florida Statutes Cited:

  • § 777.04 – Criminal Conspiracy: Criminalizes agreements to commit offenses, including fraud and obstruction.
  • § 718.111(1)(d) – Condominium Act: Financial Misconduct: Prohibits kickbacks and misuse of association assets by directors or officers.
  • § 812.014 – Theft and Embezzlement: Misuse of association-paid labor or resources for personal projects may be prosecuted as theft.
  • § 838.022 – Official Misconduct: Applies to falsifying or concealing records to benefit personally or obstruct investigations.

Residents, employees, and contractors who report misconduct are protected under the Florida Whistleblower Act, including:

  • Chapter 112 (Public Sector)
  • Chapter 448.102 (Private Sector)

These laws prohibit retaliation against individuals who report illegal activity, gross mismanagement, or violations of law. Whistleblowers are protected from dismissal, discipline, or any adverse action taken in retaliation for their disclosures.

πŸ“‚ Official Records & Unit Owner Rights

As part of its investigation, the Hills of Inverrary Audit Taskforce will be formally requesting detailed access to all relevant association documents, including but not limited to financial records, contracts, meeting minutes, and official email communications. These requests are made in full compliance with Florida Statutes § 718.111(12), which guarantees unit owners the right to inspect and copy the official records of their condominium association.

Under Florida law:
  • Associations must maintain official records for at least 7 years.
  • Records must be made available within 5 business days of a written request.
  • Unit owners may inspect records within the county or within 45 miles of the condominium.
  • Associations may charge only reasonable costs for copies.
  • Denial of access may result in damages of $50 per day, plus attorney’s fees.
The Audit Taskforce will exercise these rights on behalf of concerned residents to ensure transparency and accountability. Any obstruction or delay in providing access may be treated as a violation of state law.
